Legal Description: Commencing at the Northeast Corner of the Southwest Quarter of Section 22, Thence S 0°48’W, on the East line of the Southwest Quarter, 1,326.45 feet; thence N 90°0’W, on the South line of the North Half of the Southwest Quarter, 363.95 feet to the Point of Beginning; thence continuing N 90°00’W, 329.05 feet; thence N 0°48’E, 202.32 feet to the Point of Beginning all in Section 22, Township 90 North, Range 10 West of the 5th P.M., Buchanan County, Iowa.

Earnest Money Payment: A 10% non-refundable, earnest money payment is required on the day of the auction. The earnest money payment may be paid in the form of cash or check. All funds will be held in the Roberts & Eddy, P.C. Trust Account.

Closing: Closing will occur on or about Friday, June 25, 2021. The balance of the purchase price will be payable at closing in the form of cash, cashier’s check, or wire transfer.

Possession: Possession of the property will be given at closing.

Farm Lease: The current farm lease on the Farm Land is in place until February 28, 2022. The farm will not be open until the 2022 farm season. Seller will retain the rent for the 2021 season.\

Contract & Title: Immediately upon the conclusion of the auction, the high bidder will enter into a Purchase Agreement as well as provide the 10% earnest funds to be held in the Roberts & Eddy, P.C. Trust Account. The Seller will provide a current abstract at their expense. The sale is not contingent upon Buyer financing. Septic will need to be inspected at the Buyers expense prior to closing. All repairs will need to be made within the time allotted by the Buchanan County Health and Zoning Department or the Buyer can agree to demolish the home. The property includes a well, but there is rural water to the pump house.

Other: This sale is subject to all easements, covenants, leases, and restrictions of record. The property is sold on an “As Is” basis with no warranties, expressed or implied. The Sellers will be represented by Roberts & Eddy, P.C.
